Pacers brawl defendant seeks to question prosecutor

AUBURN HILLS, Mich. -- A lawyer for the man accused of starting the Nov. 19 brawl at The Palace by throwing a drink at Indiana Pacers player Ron Artest is seeking the testimony of Oakland County Prosecutor David Gorcyca.\nAttorney Shawn Smith said he wants Gorcyca to testify about the alleged bad blood between his client, John Green, and the prosecutor when they were neighbors in Royal Oak more than a decade ago.\nSmith wrote Gorcyca's office Monday, saying he is using the same logic that prosecutors used when they sought the testimony of a lawyer for a man accused of throwing a chair during the brawl between Indiana players and Detroit Pistons fans.\n"As you recall, David Gorcyca, when he first saw the videotape of the incident, publicly stated that he recognized John Green as the person who threw the cup," Smith wrote. "Therefore, under your office's logic, he is an eyewitness and he cannot be the lawyer/prosecutor in this case."\nOn Wednesday, a judge said attorney Kenneth Karasick of Flint has to testify for the prosecution against his client, Bryant Jackson. Auburn Hills police say Karasick identified his client from a brawl videotape.\nGreen, 39, of Oakland County's West Bloomfield Township, is charged with two misdemeanor counts of assault and battery.\nAssistant Prosecutor Paul Walton told The Detroit Free Press that his office has not received a subpoena from Smith and Smith has not filed a motion to have Gorcyca testify.\nOn Wednesday, three men received probation for their parts in the brawl. Green, three other fans and five Indiana players are charged with misdemeanor assault and battery. One fan is accused of violating a local ordinance. And Jackson is charged with a felony assault.
